Waterfront Condo case nears resolution as Pattaya awaits Land Department decision

Pattaya Mayor Poramet Ngampichet oversees safety measures at the Waterfront Condominium while the city awaits the Land Department’s decision on whether the controversial building’s title deed will be revoked.

PATTAYA, Thailand – The long-standing “Waterfront Condominium” case, unresolved for over a decade in Bali Hai area, is approaching a conclusion as Pattaya city awaits a decision from the Land Department on whether to revoke the property’s title deed.

Pattaya Mayor Poramet Ngampichet explained that two years ago, the Office of the National Anti-Corruption Commission (NACC), Region 2, informed the city and Banglamung district that the land title certificate (Nor Sor 3), issued from Sor Kor 1, was legally invalid. The certificate had been granted for land that was publicly owned, prior to a Ministry of Interior decree designating the area as a restricted mountain zone. Both Pattaya city and Banglamung district agreed with the NACC’s assessment and officially communicated that the land should be considered public property.



The matter is now under review by the Land Department, which will decide whether to revoke or uphold the title deed. Regardless of the outcome, Pattaya city is prepared to take action:

  1. If the Land Department revokes the title, the city and Banglamung district will enforce the removal of the building from public land, following the Ministry of Interior regulations (B.E. 2553).

 

  1. If the title is not revoked, Pattaya will consider applications to modify the building so the project can proceed in compliance with building and related laws.


Mayor Poramet emphasized that while awaiting the Land Department’s decision, the city has monitored and ensured the building’s safety. Project owners have been instructed to maintain the structure to prevent debris from falling and endangering the public or tourists.

The case has drawn attention from lawmakers, including a recent inquiry by a Chonburi MP, and multiple parliamentary questions have been sent to the Ministry of Interior. The Ministry has consistently forwarded the queries to Pattaya city and Banglamung district for responses.
